Zhuhai Free Trade Zone

The Zhuhai Free Trade Zone, With an Area of three sq km, established in November 1996 approved by the State Council, is the 15th Free Trade Zone in China. It is a base for processing export, bonded warehousing and international trade. It has attracted more than 150 enterprises from Germany, Japan, the USA, Canada, Australia, Taiwan, Hong Kong, Macao and other places. The industries in the Zone cover maintenance of aircraft engines, production of aeronautic apparatus, manufacturing of electronic parts, optic-fiber components, medical equipment, biopharmaceuticals, bonded warehousing and logistics management.

With an area of 3 square kilometers and situated in the southern part of Zhuhai Special Economic Zone, Zhuhai Free Trade Zone was established on November 3, 1996 with approval of the State Council. The imported goods used within the Free Trade Zone, with the exception of automobiles, are exempted from the levying of import tariff, value-added tax and consumption tax. With the exception of those goods whose exports are governed by quotas and those goods whose imports and exports are banned by the state, other goods can come to or go out of the Free Trade Zone freely without levying of tariffs and the need to apply for licenses. Zhuhai Free Trade Zone has key developments in processing and manufacturing industries, bonded warehousing industry, international trade, the industry of commodities exhibition, international transportation, finance and insurance, counseling services of international economy and scientific and technological information, and other service sectors.

Zhuhai National Level Hi-tech Industrial Development Zone

The Zhuhai State-Level New-and High-Technology Industrial Development Zone, established upon approval by the State Council in 1993,has an area of 9.8 sq km. The scope of the Zone was adjusted in 1999,with the approval of the Ministry of Science and Technology. It now contains four technology-based industrial parks, namely, Sanzao, Nanping, Xinqing and Baijiao, and an Innovation Beach. The Zone covers 16.8 sq km. Among the 53 new-and high-tech development zones in China, the Zhuhai Industrial Development Zone ranked 22 by comprehensive economic strength in 2002.

Established with approval of the State Council in December 1992, Zhuhai National Level Hi-tech Industrial Development Zone is a national level development zone composed of Nanping, Sanzao, Xinqing and Baijiao Science and Technology Industrial Parks as well as Guangdong Zhuhai Model Base for Industrialization of Hi-tech Achievements.

1. Nanping Science and Technology Industrial Park: Occupying an area of 4.2 million square meters and situated in the Nanping Town in the suburb of Zhuhai City, the park is a garden-type science and technology industrial park focused on the development of such hi-tech industries as electronics and IT, biological pharmaceutics, new energy and new materials with supporting conventional industries.

2. Sanzao Science and Technology Industrial Park: Occupying an area of 2.66 million square meters and situated along the West Airport Road, the western District, Zhuhai, it is a hi-tech industrial park with the development of such industries as electronics and IT, biological pharmaceutics and environmental protection as the main hub and other hi-tech industries as the complementary sets.

3. Xinqing Science and Technology Industrial Park: With an area of 3.44 million square meters, it is situated on both sides of the Industrial Corridor of Zhufeng Avenue in Doumen, Zhuhai City. It is a professional industrial park focused on the development of electronics and communications, especially printed circuit boards.

4. Baijiao Science and Technology Industrial Park: With an area of more than 4 million square meters, it is located on the edge of Baiteng Lake in the center of the grand Western District of Zhuhai City. It has key developments in such pillar industries as light industry, machinery manufacturing, new materials, environmental protection technologies and "three high agriculture". The industrial park is composed of the South Block and the North Block, with the former devoted to the development of industrial projects and the latter to the development of hi-tech agricultural projects.

5. Guangdong Zhuhai Model Base for Industrialization of Hi-tech Achievements: it is located on the edge of Tangjia Bay and the side of Gangwan Avenue. With the transformation of achievements of science and technology and the management of modern enterprises as the contents of demonstration, the Model Base introduces hi-tech achievements and venture investments for science and technology, and takes the major four high technologies of electronics and IT, biotechnology, photomechatronics and new materials highly stressed in Guangdong Province as the main development directions.

6. Technological Innovation Beach
Also known as Zhuhai Model Base for Industrialization of Hi-tech Achievements, Zhuhai Technological Innovation Beach is an important constituent of Zhuhai National Level Hi-tech Industrial Development Zone; co-sponsored by Zhuhai municipal government and the Torch Program Center of the State Ministry of Science and Technology, it is a "corridor" of hi-tech industries spearheaded by such high technologies as electronics and IT, computer software, network communications and photomechatronics.
Situated on the edge of Tangjia bay in the northern suburb of Zhuhai City and on the side of Gangwan Avenue and with fresh air and scenic environment, Zhuhai Technological Innovation Beach stands on the foot of the hill and near the sea. It is connected with Zhongshan University, Zhuhai Campus in the south and links with the entrance of the Beijing-Zhuhai Express. To its west lies the Zhuhai University Science and Technology Park and it is close to Hong Kong in the east.
At present, nearly 30 enterprises have entered the Technological Innovation Beach, including the Software Development Center of the Head Office of Industrial and Commercial Bank of China, Southern Software Park Co., Ltd. of Ministry of Information Technology, the New Economic Resources Development Harbor of Harbin Institute of Technology Group and Tsinghua Science Park, etc.

QSI International School of Zhuhai was founded in 1999, and its textbooks and course setups originate from the United States. Zhuhai Harbor Industrial Zone

The Zhuhai Harbor Industrial Zone, located in the west of Zhuhai, was listed as one of the four key development areas of Guangdong Province in 1992.Occupying 100 sq km, it has one of the country's key coastal ports, which is cited as a State Class A port. The deep and extensive harbor expanse, and ample resources of land and water provide a sound environment for the operation of chemical and energy industries, and dock warehousing. Located in the west part of Zhuhai City and with a planned area of 64.44 square kilometers, Zhuhai Harbor Industrial Zone will have key developments in large-scale industries of energy, petrochemical, machinery and warehousing. Zhuhai Port, which is within its jurisdiction, is one of the hub harbors in southern China and a national Grade A port. Zhuhai Port now has two 20,000-ton class berths for bulky goods and containers, one 80,000-ton, one 50,000-ton and two 5,000-ton class berths for liquefied gas and chemical products as well as subordinated storage zone and two 50,000-ton class coal berths.

Hengqin Development Zone

Hengqin, connected to Macao,a free trade port, by the Lianhua Bridge has been listed as one of the four key development zones in Guangdong Provonce.The development strategy of Hengqin is to promote commerce and trade through tourism. The Zone concentrates on three types of economic endeavors: first, as an island, striving to promote tourism economy; second, by making full use of its advantage of being very close to Macao, pressing forward with the logistics industry, by making full use of its geographical resources, optimizing its industrial structure, and developing its environmental protection industry and building a green science and technology park.

With an area of 96 square kilometers, it is an economic development zone established in 1992 with approval of Guangdong Provincial Government. Focused on the development of tourism with island features, it also develops such sectors as commerce and trade, catering, finance and real estate. Hengqin Port is a Grade A port of the nation and is the second important channel linking the Mainland with Macao.

Wanshan Ocean Development Testing Zone

In 1998,the People's Government of Guangdong province approved the establishment of the Wanshan Marine Development Experimental Zone. This is the first local marine comprehensive development experimental zone in the province. In the Zone, there are 146 bays of different sizes, suitable for building deep-water docks and large transit warehouses. At present, there are 20 docks of various sizes, and 39 berths. To meet the demand of local economic development, the State Council approved the upgrading of the rank of Wanshan Port on April 29,2003.The Zone is rich in marine resources. Cobia and purple sea urchin raised here are exported to Japan, the US and European countries. At the same time, the island scenery itself is a fine tourism resource.

Eleven of China's renowned universities have established branch campuses in Zhuhai.The branches of Zhongshan Universitym,Jinan University,Beijing Nomal University,Beijing Institufe of Technology,Jilin University,Zhuhai Medoca School and Guangdong Science and Technology Cadre College began to enroll students in 2000.In 2003,there are 38,000 full-time university students in Zhuhai.The ratio of university students to the local population is one of the highest among China's large and medium-sized cities.It is estimated that full-time university students will exceed 50,000 in 2005,and exceed 100,000 in 2010.

Elementary Education
The municipal government of Zhuhai pays great attention to elementary education.Today,there are 239 primary and middle schools in the city,with an enrollment of 178,958.Nine-year compulsory education is fully implemented;all children who have reached school age are enrolled in schools.Famous middle schools such as the Middle School Attached to People's University in Beijing and the Middle School Attached to Beijing University have become new forces contributing to Zhuhai's elementary education.

Continuing Education
To cater to the demand for educated people to assist the economic development of the Special Economic Development Zone, concerted efforts have been made by the government and social organizations in running 180 schools of various types, namely, adult higher-learning institutions, adult secondary specialized schools, adult technical training colleges and adult culture and technology schools at the town level, as well as non-degree adult educational institutions. This has played positive role in enhancing the local people's cultural level.

Intellectual Property Protection

Zhuhai stresses the protection of intellectual property rights,and has adopted various measures to actively implement the relevant State laws and regulations.In 1996,the Press and Publications Bureau was set up,to work on behalf of the municipal goverment exercising supervision and administration,and providing services to the press and publications sector.

Zhuhai Science and Technology

Zhuhai's new-and high-technology industry is thriving,and its scientific and technical innovation capability is increasing steadily.Today,there are 79 new-and high-tech enterprises certified by provincial authorities.In 2002,the output value of products made by the city's new-and high-tech enterprises reached RMB 21.835 billion,representing 27.6% of the total industrial output value of the whole city.
State Software Industry Base: There were 116 software enterprises and 395 software products certified by provincial authorities in 2002.The industrial output value of this software park was RMB 2.332 billion,an increase of 46% over the previous year.

On contributing technology to become shareholders

The scientific and technical personnel of the scientific research institutes and institutions of higher learning as well as any other holders of technological achievements both at home and abroad are encouraged to contribute their technology to become shareholders and establish businesses in the Hi-Tech Zone.


The scientific and technical personnel of the scientific research institutes and institutions of higher learning as well as any other holders of technological achievements are allowed to establish hi-tech businesses with their non-post technological achievements as share equity, and they are allowed to assume such posts as corporate directors, supervisors and managers.


When a software enterprise is registered, the copyright of software products, technical know-how and patents can be priced as shares in accordance with the provisions of the "Rules of Zhuhai on Contributing Technological Achievements to Become Shareholders and on Related Royalty", and the percentage of such contribution can be 35% of the registered capital; for those software technologies and products with tremendous market potential and high added-value, the percentage of such contribution in the registered capital can be determined by the investors themselves.


For common technological achievements, their equity percentage in the registered capital of the company shall not exceed 20%; the equity ratio for hi-tech achievements can reach 35% of the registered capital of the company.

On the exemption of administrative charges

In principle the enterprises within the Hi-Tech Park are exempted from various administrative charges of the municipal or lower levels.


The various expenditures of private enterprises on research and development of new techniques, new technologies, new equipment and new products as well as initiating hi-tech enterprises are allowed to be counted into the managerial costs.

On human environment

The procedures of job transfer, approval for going abroad, admission of children into kindergartens and schools involving scientific and technical personnel will be handled with preference; scientific and technical personnel who have made outstanding contributions in the research and development, and transformation of achievements, can be recommended to awards of professional and technical titles in a way breaking the common rule.


For those who establish enterprises and projects within the Hi-Tech Zone, priorities will be given to such aspects as transfer of cadres, recruitment, employment of college graduates and obtaining residence permits. The personnel who have university degrees or intermediate technical titles and have assumed work posts in the enterprise within the Hi-Tech Zone for more than one year, can apply to transfer their registered permanent residence into Zhuhai City and are exempted from the fees for city construction. Their spouses and children can process the transferring formalities at the same time.


Establish Industrial Park for Overseas returning Students within the Hi-Tech Zone. Those who have obtained the right of long-term residence abroad or established corporations in foreign nations, can go through business registration as foreign investment enterprises and are entitled to the preferential treatments of foreign investment enterprises.
Overseas returning students are not confined by the set-up system and gross payroll of employers, and their length of service both before their going abroad and after their return from abroad can be counted together. With regard to the appraisal of professional and technical titles and engagement, they are not confined by the number of work posts and appraisal time limits.
The children, spouses and parents of overseas returning students can apply for registered permanent residence at the same time and are exempted from the fees for city construction. Their children are entitled to the same treatment as the people with registered permanent residence of the city with respect to admission to kindergartens and primary or middle schools, and are also entitled to the most preferential conditions specified for the children of returned overseas Chinese in with respect to school admission through examination.
For those overseas talents working in the Hi-Tech Zone, they can apply for car licenses valid in both Zhuhai and Macao.


The software enterprises established by overseas returning students are entitled to various preferential policies of the city .


It is guaranteed that the overseas returning students can go abroad and come back freely and they are free to remit their legal personal income out of China.
Beginning from the year 2000, for those high level talents including academicians and leaders of subjects who come to work in Zhuhai, good conditions for living and scientific research will be provided, and appropriate working environment will be created for them. For the necessary assistants he/she brings in, they will be given assistance in their transfer of permanent residence to Zhuhai and they are exempted from the fees for city construction.
For those talents who have worked in Zhuhai for more than two years and have a university degree, intermediate technical titles or above and whose registry of permanent residence is not in Zhuhai, the admission of their children into the kindergartens, primary and middle schools are entitled to the same treatment as that of the people with the registry of permanent residence of the city.


The teaching and managerial personnel of university campuses can transfer their registries of permanent residence into Zhuhai City and they are exempted from the fees for city construction. The transfer of the registry of permanent residence of their spouses and near relatives will be dealt with in accordance with the relevant provisions of our city. The admission of their children into the kindergartens, primary and middle schools are entitled to the same treatment as that of the people with the registry of permanent residence of the city.


Those enterprises that have fulfilled the following conditions can apply for the transfer of the registry of permanent residence and are exempted from the fees for city construction: they can apply for the registry of permanent residence for one person and this shall be dealt with after the capital verification has been conducted.
For private enterprises of production and science type, for every 80,000 yuan of annually-paid tax, they can apply for the registry of permanent residence of one person; if they have operated consecutively for over three years and have paid tax of over 200,000 yuan within 3 years, they can apply for the registry of permanent residence of 2 persons.
After being verified by the provincial and municipal scientific administrations, private enterprise of production and science type can apply for the registry of permanent residence of one person for every 60,000 yuan of annual tax; if they have operated consecutively for over three years and have paid tax of over 150,000 yuan within 3 years, they can apply for the registry of permanent residence of 2 persons.
Other enterprises can apply for the registry of permanent residence of one person when the tax paid is100,000 yuan or above; if they have operated consecutively for over three years and have paid tax of over 280,000 yuan within 3 years, they can apply for the registry of permanent residence of 2 persons.


After the managerial personnel and technical backbone staff of inland associated enterprises have worked for two years, if they are really excellent, the enterprise can submit an application for transferring their registries of permanent residence into the city.
Each year, the municipal government plans to allocate a certain number of quotas for the registry of permanent residence to inland associated enterprises. The transferring formalities for the registry of permanent residence can be dealt with after the Municipal Office of Economic Coordination examines according to the following conditions and approval from the municipal Bureau of Public Security is obtained: contract term is over five years; the fixed assets of the inland party are over RMB 500,000 yuan; have actually invested and have good economic results; belong to managerial personnel and technical backbones of the enterprise and have worked in Zhuhai for over two years, and the original employer agrees; comply with the conditions for registry of permanent residence specified by Zhuhai Municipal Government.
For the children of those cadres in the inland associated enterprises, whose registries of permanent residence are not in Zhuhai, they can have temporary schooling in schools in Zhuhai and can apply to take part in graduation exams in our city. For those meeting graduation requirements, the admission schools of our city will issue them graduation certificates.

Preferential loans, entitlement to funds and interest subsidy:

Set up an interest subsidy loan fund for scientific and technological type enterprises. Each year, the municipal government will invest 10 million yuan and entrust the municipal science committee and Commercial Bank to form a special institution for management of the fund and providing collateral of loans for scientific and technological type enterprises.


For the transformation within the Hi-Tech Zone of hi-tech achievements brought in by inland scientific research institutes and overseas returning students, they have the priority in their entitlements to venture loans and project subsidy on interest payment.


Overseas returning students can apply for business registration in the Hi-Tech Zone with their passports. For those overseas returning students who become shareholders with hi-tech contribution, they have the priority in obtaining the support of a business initiation fund.


Each year, a certain sum is allocated from the science and technology fund of the city as subsidy on interest payment to support institutions of higher learning and their students to engage in the transformation of hi-tech achievements or projects, or to conduct the research and development of hi-tech projects.


Set up a special development fund for biological pharmaceutics to support the import of biological pharmaceutical technology, technological innovation and development of new products. Increase interest subsidy on the loan for the technological innovation and transformation of enterprises; for the projects of key technological transformation and development of new products, give them preferential treatment in application for the loan interest subsidy projects of state and provincial level technological transformation, and meanwhile, give them priority in granting the municipal level loan interest subsidy of technological innovation and transformation.


For an enterprise which is registered in our city and whose investment ratio in the hi-tech industrial field of our city is no lower than 70% of its total investment amount, it can be granted preferential taxation policies with reference to the hi-tech enterprises of our city, and it is allowed to withdraw a risk compensation sum of 3-5% of its total revenue of that year to compensate the investment loss of the previous year and that year; the balance of the risk compensation sum can be carried down on a yearly basis, but this sum shall not exceed 10% of the net assets of the enterprise by the end of that year.


Each year the municipal financial department allocates special grants as loan interest subsidy for leading agricultural enterprises.

On financial subsidies

Each year, the municipal financial department will allocate a certain amount of science and technology subsidy to the projects of hi-tech achievements with prospects for development, and it will also increase fund allocation by 10 to 20 million yuan to give key support to the incubation and industrialization of science and technology projects, and introduce the projects of hi-tech achievements from inland colleges and universities and research institutes for industrialization in Zhuhai.


The teaching and managerial staff of university campuses are granted financial subsidies of Special Economic Zone. The subsidies will be verified and allocated in accordance with the equal standards of state and Guangdong provincial institutions residing in Zhuhai on a scale of 10ˇŚ?1 between full-time students of that year and teachers.


The software industry development fund is set up to support the facilities for the state and provincial level software projects and the application of software to the promotion of industrial reconstruction. Such development fund adopts such forms as interest subsidy for project loans, subsidies and rewards, and it will be used in an rollover mode.


The Financial special account is set up for supporting the software industry. The local retained portion of the income taxes paid by software business as is transferred into the special account, and will be used for supporting the development and innovation of software enterprises.


For the managerial and technical personnel of software enterprises, an amount of 4,000 yuan for subsidies and expenses can be deducted each month before levying of personal income tax, and the local retained portion of the due personal income tax is transferred into the special account for supporting the software industry. The fund in the special account can be rewarded to the staff members of the enterprises according to the amounts of their contributions.

The software enterprises that have entered the software park are entitled to: a 30% reduction of communications fees compared with that outside the park, and the government subsidies for rents for 3 years at the rate of 10-square-meter office area for each of managerial and development personnel.


Special fund for promoting software export is set up for export of software, market promotion and projects promotion.


To those enterprises that pass the certification of CMM rating 2 or above, the government will give a reward of 500,000 yuan in one lump sum.




For the residing post-doctoral research fellows, in addition to their entitlement to the treatments specified by the state and the province, the municipal financial department will allocate special grants to give an annual subsidy of 40,000 yuan per person.

The Procedures for Divorce Registration

A、 Application

The applicants must file an application with the Marriage Administration Office of the Zhuhai civil Affairs Bureau with the valid proofs and certificates

B、Divorce Mediation

The Marriage Registration Administrative Office shall examine the parties’ application for divorce and where the conditions for divorce are met, register the divorce, and inform applicants to get the Divorce Certificate within one month after the 15 days’ of examination that takes place upon the receipt of the application.

                  About the Top Four
  Mud crabs live in swampy areas where they usually need to peel four times before attaining adulthood. At the fourth peeling, they become peeler crabs. The peeler crab is only found in brackish water - a mere 1% is available at fisheries. Its body glazes when cooked and the meat tastes tender and fresh. It contains plenty of protein, and is an invigorating food loved by gourmets in Hong Kong, Macao and Taiwan.
  The water flows smoothly around Hengqin Island, with adequate salinity and temperatures, full of nutrition without pollution, and therefore is ideal for oyster growth. The Jumbo Oyster is delicious, tender, sweet and fresh, and it's famous for its huge size, meaty body, white colour, tender taste, and crisp texture. It's considered a good tonic food.
  The lotus root farmed in the Baiteng Lake area is natural, pollution-free and is also considered a tonic. It's famous in Hong Kong and the Macao area for its large size and pulpy texture.
  The crystal prawn is one of eight important staple marine products. Wanshan Islands have a long history of prawn farming. The prawn is good steamed, fried, or minced for dim sum and other styles of dishes.

Shopping in Zhuhai

  Throughout this city, supermarkets are devouring market share from traditional department stores. The shopping mall at the former International Trade & Exhibition Center site is a quasi-American style mall.
  Four shopping areas in the city each have their own market niche. The Jingshan Road shopping area in Jida is relatively newer than the others. Jingshan Honest Shopping Street is the backbone of the area. Along the street are the Zhuhai General Merchandise Fair, Duty-Free Emporium, Guomao Shopping Center, C-Mall,  Yinlong Commercial Building and People's Resources Supermarket.   The Yingbin South Road area takes the Gongbei Port Square as its center. Along the road are the Vanguard Supermarket, the Port Underground Shopping Center, Yingbin Plaza and other commercial facilities in a 24-hour shopping environment.
  The Fenghuang Road shopping area is the old downtown. Small roadside stores and brand boutiques highlight its character. The Xiangzhou Department Store and Jusco Supermarket are the giants of the area. According to a municipal urban renovation plan, this area will be thoroughly renovated.
  Lianhua Road is the backbone of a shopping area crossed by Yuehai and Qiaoguang roads. The area is full of small stores for garments, ornaments and daily-use items.

1. Three application forms for residing in China permanently, each with an attached recent, bare-headed, full-faced, white-background color photo and submit one more of the same size photo upon application; those applying to join the Chinese Nationality should fill out the Application letter to join the Chinese Nationality; those apply to restore fill out the Application Form for restoration of the Chinese Nationality; those applying to revoke must fill out the Application Form for revoking their Chinese Nationality.

2. The applicant must submit the application letter to join Chinese Nationality.

3. Relevant Certificates: applying to join or restore Chinese Nationality :

① One copy of the applicant’s valid passport or other valid Travel certificates .

② One copy of the Residence permit;

③ One copy of the certificates confirming the applicant’s residency;

ChapterⅠ GENERAL PROVISIONS
Article 1 The present Law is enacted for the purpose of safeguarding the sovereignty and maintaining the security and public order of the People’s Republic of China and facilitating international exchanges.
The present Law shall apply to aliens entering, leaving or passing through the territory of the People’s Republic of China and to aliens residing or travelling in China.
Article 2 Permission must be obtained from the competent authorities of the Chinese Government by aliens for their entry, transit and residence in China.
Article 3 For entry, exit and transit, aliens shall pass through the ports open to aliens or other designated ports and shall be subject to inspection at border checkposts.

Article 4 The Chinese Government protects the legitimate rights and interests of aliens within Chinese territory.
The personal freedom of aliens shall inviolable. Aliens shall not be liable to arrest unless a warrant or decision is made by a people’s procuratorate or decision is made by a people’s court and such a warrant or decision is executed by a public security organ or state security organ.
Article 5 Aliens in China shall abide by Chinese law and shall not endanger the national security of China, harm its public interests or disturb its public order.

Chapter Ⅱ ENTRY
Article 6 For entry into China, aliens shall apply for visas to the Chinese diplomatic missions or consular posts or other agencies abroad authorized by the Ministry of Foreign Affairs of the P.R.C. In specific situations and in compliance with the stipulations of the State Council, aliens may also apply for visas to visa offices at the ports designated by the competent authorities of the Chinese Government.
The entry of nationals of a country having visa agreement with the Chinese Government shall be dealt with in accordance with the said agreement.
In cases where a country has special regulations regarding the entry and transit of Chinese citizens, the competent authorities of the Chinese Government may take corresponding measures contingent on the circumstances.
Visas are not required for aliens in immediate transit on continued international flights, who stay not more than 24 hours within the airport in China. Permission may be obtained from the border checkposts for aliens wishing to leave the airport temporarily.
Article 7 In applying for visas, aliens shall present valid passports and, if necessary, provide pertinent certificates.
Article 8 Aliens invited or employed to work in China shall, in applying for visas, produce letter of invitation or employment.
Article 9 Aliens wishing to reside in China permanently shall, in applying for visas, present residence confirmation forms, which may be obtained upon application from the public security organs at the intended places of residence.
Article 10 The competent authorities of the Chinese Government shall issue appropriate visas to aliens wishing to enter China in the light of each case of application.
Article 11 When an aircraft or a vessel operating international services arrives at a Chinese port, the captain or his agent must submit a passenger list to the border checkpost, and, in the case of a foreign aircraft or vessel, mist provide a list of crew members as well.
Article 12 An alien considered a potential threat to China’s national security and public order shall not be permitted to enter China.

Chapter Ⅲ RESIDENCE
Article 13 Aliens residing in China shall possess identity cards or residence certificates issued by the competent authorities of the Chinese Government.
The term of validity of an identity card or residence certificate shall be decided in the light of each case of entry.
Aliens residing in China shall submit certificates for examination to the local public security organs within the prescribed period of time.
Article 14 Aliens who, in compliance with Chinese law, wish to have long-term residence in China for the purpose of investing in China or engaging in cooperative projects with Chinese enterprises or institutions in the economic, scientific-technological and cultural fields or for other purposes may be granted the status of long-term or permanent residence upon approval by the competent authorities of the Chinese Government.
Article 15 An alien who seeks asylum for political reasons shall be permitted to reside in China upon approval by the competent authorities of the Chinese Government.
Article 16 In the case of an alien who fails to abide by Chinese law, his period of stay in China may be shortened or his status of residence in China annulled by the competent authorities of the Chinese Government.
Article 17 Aliens wishing to make temporary overnight stay in China shall complete registration procedures pursuant to the relevant stipulations.
Article 18 Aliens holding residence certificates who wish to change places of residence in China shall complete removal formalities pursuant to the relevant stipulations.
Article 19 Aliens who have no residence certificates or are on a study programme in China shall not be employed in China without permission of the competent authorities of the Chinese Government.

Chapter Ⅳ TRAVEL
Article 20 Aliens who hold valid visas or residence certificates may travel to places declared open to aliens by the Chinese Government.
Article 21 Aliens wishing to travel to places not open to aliens shall apply to the local public security organs for travel permits.

Chapter Ⅴ EXIT
Article 22 For exit from China, aliens shall present their valid passports or any other valid certificates.
Article 23 Aliens shall not be allowed to leave China if they come under any of the following categories:
a defendant in a criminal procedure or a criminal suspect listed by a public security organ or people’s procuratorate or people’s court.
a person under notice by a people’s court to denied exit for an unsettled civil procedure.
a person awaiting decision for any other violation of Chinese law, whose case, in the opinion of the competent authorities, call for investigation.
Article 24 Border checkposts have the power to withhold exit of aliens coming under any of the following categories land to subject them to rules of the law:
a holder of invalid exit certificate;
a holder of an exit certificate other than his own;
a holder of a forged or altered exit certificate.

Chapter Ⅵ ADMINISTRATIVE ORGANS
Article 25 China’s diplomatic missions and consular posts and other abroad authorized by the Ministry of Foreign Affairs are the agencies of the Chinese Government abroad to handle aliens’ applications for entry and transit.
The Ministry of Public Security, its authorized local public security organs, the Ministry of Foreign Affairs and its authorized local foreign affairs offices are the agencies of the Chinese Government at home to handle aliens’ applications for entry, transit, residence and travel.
Article 26 The authorities handling aliens’ applications for entry, transit, residence and travel have the power to decline issuing visas and certificates or to cancel or annul visas and certificates already issued.
The Ministry of Public Security and the Ministry of Foreign affairs may, if necessary, alter decisions made by their respectively authorized organs.
Article 27 An alien illegally entering or residing in China may be detained for investigation or subjected to residence supervision or deportation by public security organs at and above country level.
Article 28 Police in charge of aliens’ affairs in the public security organs at and above country level have, in performing their duties, the power to examine aliens’ passports and other certificates. When conducting such examinations, the said police shall produce their own service cards, and the organizations or individuals concerned are obliged to assist.

Chapter Ⅶ PENALTIES
Article 29 Whoever illegally enters, leaves, resides or stops over in China, or travels to places not open to aliens without valid travel permit or forges, alters, misuses or negotiates entry or exit certificate in contravention of the provisions of the present law may be subjected to such penalties as warning, fine or detention for not more than ten days, by the public security organs at and above county level. Offenders whose violations are serious enough to constitute crimes shall be prosecuted in accordance with law.
If an alien being fined or detained by a public security organ refuses to accept a penalty, he may, within fifteen days of receiving notification, appeal to the next higher public security organ, which shall make the final judgement, and/or may file a suit directly in a local people’s court.
Article 30 The Ministry of Public Security may order serious offenders as listed in Article 29 of the present Law to leave the country within a time limit or may expel them.

Chapter Ⅷ ANCILLARY PROVISIONS
Article 31 The term “alien” used in this Law refers to any person not having Chinese nationality under the Nationality Law of the People’s Republic of China.
Article 32 Transitory entry into and exit from China by aliens who are nationals of countries adjacent to China and reside in contiguous areas between the two countries shall be handled pursuant to agreements between the two countries; in absence of such agreement, transitory entry and exit shall be handled in accordance with the relevant stipulations of the Chinese Government.
Article 33 Rules for implementation of the present law shall be formulated according to the Law by the Ministry of Public Security and the Ministry of Foreign Affairs and shall come into force upon approval the State Council.
Article 34 Matters concerning the members of foreign diplomatic missions and consular posts in the People’s Republic of China and other aliens who enjoy privileges and immunities, after their entry into China, shall be dealt with in accordance with the relevant stipulations of the State Council and its competent authorities.
Article 35 This Law shall come into force as from 1 February 1986.
